I have the honour to refer to your telegram 93 16 No.70 of the 14th of April, 1938, and to forward herewith,

for transmission to the proper quarter, the accompanying copies of depositions at the extradition proceedings, of depositions at the committal proceedings, and of the summing-up by the trial judge in the case of Chung Chi Cheung.

2. My legal advisers state that in preparing the necessary instructions they do not propose to go into the facts of the case which are not in dispute, but merely to deal with the legal point which is the subject of the appeal to the Privy Council. Whilst the Crown has nothing to add to the submissions made to the Full Court, which appear in the notes of the three judges who comprised that Court and also in the judgment of that Court, it would be of assistance if your solicitors would indicate, after a perusal of the notes and judgment, any particular points which they desire to be dealt with specially in their instructions.
